Terms of Service

Last updated September 2026. The agreement that applies when you use BrandPatrol's monitoring, case-file, and agency workspace services.

The service

BrandPatrol monitors public search-engine results and the public ad-transparency record for unauthorized use of your brand's keywords, traces flagged ads back through their redirect chain, and compiles the result into case files with supporting evidence. The keywords watched, the regions and devices covered, and how often scans run are set by your plan or the quote you agreed to — a snapshot audit runs once; continuous monitoring runs on an ongoing schedule.

What this service doesn't do

BrandPatrol doesn't take enforcement action on your behalf. We don't file complaints in your name with an ad network or affiliate platform, we don't send cease-and-desist letters, and nothing here is legal advice. You get the case file — evidence, redirect chain, tracking parameters, status — and enforcement stays with you, your network, or your counsel.

Automated takedown or complaint filing Coming soon is not part of any current plan. If it ships, it will be a separate, clearly labelled capability — not something quietly bundled into monitoring.

No outcome guarantee

Detection depends on an ad actually serving at the moment a scan runs. No monitoring tool — ours included — observes every impression an ad platform serves, so a scan can miss a hijacker that wasn't showing when it looked, or catch one that a different scan window would have missed. Whether a flagged case results in a takedown, a commission clawback, or any other outcome is decided by the ad network or affiliate platform involved, not by us.

Your responsibilities

You're responsible for keeping your login credentials confidential, and for the accuracy of the keywords, domains, and authorized-partner roster you give us to monitor — a stale roster is the most common reason an approved partner gets flagged as a hijacker. Agency accounts are responsible for having the authority to manage each client brand they onboard into the workspace.

Billing

Paid plans are quoted from your keyword volume, target regions, devices, and scan cadence, then invoiced on the agreed schedule. A snapshot audit is billed once; continuous monitoring renews on the agreed cycle until cancelled. There's no lock-in: cancelling takes effect at the end of the current billing cycle, not mid-cycle. We don't currently offer self-serve card checkout — plans are quoted and invoiced, not charged automatically at signup.

Acceptable use

The service is for monitoring your own brand, or brands you're explicitly authorized to manage on an agency account. Don't use it to monitor a brand you have no relationship to, don't scrape or resell the raw output, and don't repurpose a case file to target a brand outside the one it was produced for.

Evidence and intellectual property

Case evidence produced for your brand — screenshots, redirect chains, extracted parameters, and the case file built from them — belongs to your brand, and you're free to use it in your own disputes with a network, platform, or partner. BrandPatrol retains all rights in the underlying platform: the scanning, tracing, and workspace software itself.

Confidentiality

We treat the keywords, roster, and case data you give us as confidential, and won't disclose them outside the accounts you've granted access to. In turn, don't share your login credentials or workspace access outside your own organization.

Suspension and termination

We can suspend or terminate a workspace for non-payment or for a breach of the acceptable-use terms above. On termination, case evidence and account data are retained only long enough to process a data request or resolve a dispute, then handled under the deletion terms in our Privacy Policy.

Liability

The service is provided on a best-effort basis. To the extent permitted by law, BrandPatrol isn't liable for indirect or consequential losses arising from a missed detection, a delayed case, or an enforcement outcome outside our control. Nothing in these terms overrides rights you have under mandatory law in your jurisdiction that can't be waived by agreement.

Changes to these terms

We'll post updates to these terms on this page and change the "last updated" date above. Continuing to use BrandPatrol after a change takes effect means you accept the updated terms.
